The use of services from PAMIRWEBHOST LLC [hereafter referred to as “PAMIRWEBHOST LLC”] constitutes agreement to these terms. PAMIRWEBHOST LLC users are entirely liable for all activities conducted through your administrator and all your end clients accounts. The following terms of service are designed to provide the highest level of service available.

1. Acceptance of Terms

The use of services provided by PAMIRWEBHOST LLC (hereafter referred to as “PAMIRWEBHOST LLC”) constitutes your agreement to abide by these Terms of Service. As a user of PAMIRWEBHOST LLC, you are fully responsible for all activities conducted through your administrator account and any associated end-client accounts.
These Terms are established to ensure the delivery of high-quality, reliable, and secure services. By accessing or using our services, you acknowledge and accept these terms in full.

02. Changes

PAMIRWEBHOST LLC reserves the right to modify the Terms of Service (TOS) and Acceptable Use Policy (AUP) at any time, at its sole discretion. Any changes to these policies shall not constitute grounds for early contract termination or non-payment.
Customers acknowledge that the nature of the services provided, along with the initial rates and charges, have been clearly communicated. While service rates may fluctuate due to hardware availability or market conditions, any changes that affect a customer’s recurring monthly billing will be communicated in advance of the billing cycle.

03. Money Back Guarantee

PAMIRWEBHOST LLC is committed to providing high-quality services that meet and exceed customer expectations. To support this commitment, we offer a 25-day money-back guarantee for service-related issues encountered during the initial subscription period.
This guarantee applies exclusively to issues directly related to the performance or delivery of our shared hosting services. It does not apply to the following services:
– VPS Servers
– Dedicated Servers
– Domain Registrations

Refunds will not be issued for problems resulting from customer error, misuse, or violations of our Terms of Service. All refund requests must meet the outlined criteria and will be processed promptly and professionally.

04. Refunds

Refunds are available only for hosting services provided by PAMIRWEBHOST LLC and are subject to specific limitations. The refund applies solely to the hosting service plan and excludes additional services such as SSL certificates, domain registrations, VPS servers, and dedicated servers.
Refunds are offered only within 25 days of initial account registration and apply exclusively to the first service purchased by a new client. Subsequent orders, repeat sign-ups, or multiple accounts created by the same user are not eligible for refunds.
Violations of the Terms of Service (TOS) or Acceptable Use Policy (AUP) will void any refund eligibility. Accounts suspended or terminated due to non-compliance are also ineligible. Refunds will be granted only for valid service-related issues that cannot be resolved by our support team.
Any form of misconduct or inappropriate behavior toward our support staff
—via chat, ticket, phone, or email—will result in forfeiture of refund rights.

05. Suspension

In the event of a violation of these Terms or the AUP, PAMIRWEBHOST LLC reserves the right to suspend the offending account. As an administrator, you retain the ability to reactivate your client’s account. Once reactivated, you or your client will have 12 hours to resolve the issue.
Failure to resolve the incident within the specified time, or repeated violations by the same account, will result in permanent termination of the client account and disabling of the client profile. The administrator profile will remain unaffected. The root user is protected from any disciplinary action resulting from violations committed by their end users.

06. Billing Methodology and Information

PAMIRWEBHOST LLC issues invoices for all services 15 days prior to the due date. Customers are responsible for ensuring timely payment. Accounts that are 5 days overdue will incur a 10% late fee, which is non-negotiable and automatically applied to the outstanding invoice.
If an invoice remains unpaid for 20 days, all associated services are subject to immediate termination. Repeated late payments may result in additional fees or permanent service termination. Timely payment is essential to maintain uninterrupted service.

07. Fraud

In cases where fraudulent activity is detected, PAMIRWEBHOST LLC reserves the right to immediately suspend or terminate the associated account at its sole discretion. All available information related to the fraudulent account will be reported to relevant local authorities and financial institutions involved.
All suspected fraud orders are thoroughly investigated, and PAMIRWEBHOST LLC will pursue legal action to the fullest extent permitted by law, whether within the United States, Afghanistan, or internationally.

08. Disputes and Chargebacks

Customers agree that initiating a dispute or chargeback through PayPal, Payza, Skrill, or their credit card issuer after entering into a service agreement will result in the immediate suspension of all services.
Chargebacks made under false pretenses are considered fraudulent and will be treated accordingly. PAMIRWEBHOST LLC reserves the right to take legal action and report such incidents to relevant authorities.

09. Financial Liability

Customers acknowledge that the nature of hosting services may result in interruptions due to factors beyond the control of PAMIRWEBHOST LLC. As such, PAMIRWEBHOST LLC shall not be held liable for damages resulting from service interruptions unless directly caused by its own negligence.
In any case, PAMIRWEBHOST LLC’s liability shall not exceed the amount paid by the customer for services during the period in which damages occurred. Violations of the TOS or AUP may result in immediate termination of services without refund.
PAMIRWEBHOST LLC is the sole authority in determining violations of these provisions. A fine of USD 150 may be imposed for intentional server abuse or violations of the TOS/AUP.

10. Support

PAMIRWEBHOST LLC provides hardware-related support for server functionality. Software support is only available for services designated as Fully Managed. For fully managed hosting, PAMIRWEBHOST LLC guarantees default software installation but does not assume responsibility for software configuration.
We are not liable for data loss resulting from misconfigured scripts. Enhanced support services, including script configuration and site development, may be available for an additional fee. Please contact our Sales or Billing department for pricing.
Customers may request new PHP extensions or features via support ticket. PAMIRWEBHOST LLC does not provide support to third-party customers (i.e., customers of our customers). Support is offered exclusively to direct customers of PAMIRWEBHOST LLC.

11. Data and Backups

PAMIRWEBHOST LLC performs monthly backups on all shared and reseller servers to help safeguard critical data. Our servers are equipped with Hardware RAID 10 arrays, ensuring that primary drive data is mirrored to secondary drives for added redundancy.
Please note: – Daily backups are not provided for user websites.
– Users are responsible for manually creating and downloading their own backups.
– Backup restoration is reserved for emergency situations only.
– PAMIRWEBHOST LLC does not restore files that users have accidentally deleted or modified. We are not liable for data loss, time, income, or other resources resulting from faulty or missing backups. Backup services do not cover VPS Servers, Dedicated Servers, Semi-Dedicated Servers, Cloud VPS Servers, VOS Servers, or VoIP Servers unless the customer has purchased optional AWS backup services.
Customers are strongly advised to maintain independent backups of their data. In the event of a serious server issue, our technical team can assist with restoring customer-provided backups.

12. Transfer / Migration

PAMIRWEBHOST LLC offers courtesy site transfers to assist new customers in migrating their websites. While we strive to make the process smooth, we cannot guarantee the availability, feasibility, or timeframe for completing a transfer.
Due to differences in hosting configurations and proprietary data formats, some transfers may be partially successful or not possible. Free transfer services are available within 30 days of account signup. Transfers requested after the 30-day period will incur a fee—please contact our Transfers Department for a quote.
PAMIRWEBHOST LLC also reserves the right to migrate customer accounts between data centers as needed to comply with data center policies, local laws, or technical requirements, without prior notice.

13. DMCA Complaints

PAMIRWEBHOST LLC takes DMCA complaints seriously and investigates all claims thoroughly. Use of our services to infringe upon copyrights or trademarks is strictly prohibited.
This includes, but is not limited to:
– Unauthorized copying of music, books, photographs, or other copyrighted materials.
– Sale or promotion of counterfeit merchandise.
Accounts found in violation will be immediately terminated, and access to infringing content will be disabled. Repeat violations will result in suspension or permanent termination of hosting services.
If you believe your copyright or trademark is being infringed, please contact us at abuse@pamiralpha.com with relevant details. For licensing-related issues, additional documentation may be required.
We encourage all users to respect intellectual property rights and follow our DMCA and abuse complaint procedures.

14. Usage and Overages

PAMIRWEBHOST LLC’s service plans are designed to meet the typical needs of most customers. However, usage may vary, and additional resources—particularly in storage and bandwidth—may be required.
– We do not automatically charge your card for overages. Instead, you will receive an email notification (e.g., at 80% bandwidth usage) if your account approaches its limits.
– It is your responsibility to keep your email address updated in your cPanel to receive such alerts.
– If you exceed your resource limits and do not contact us to upgrade, your account may be automatically suspended.
Our hosting services are intended for website hosting, not for remote file storage. If more than 70% of your disk space is used for file storage (by size or file count), it will be considered excessive. If such files are found to be illegal or harmful, you will be notified. If not, and your intent is legitimate, no action will be taken.
Resource usage limits: – No process may use more than 90% of one CPU core for over 15 minutes.
– No service may use more than 200% of two CPU cores for over 2 minutes.
– If these thresholds are exceeded, resource limits will be enforced automatically.

15. IP Blacklists

If a customer—or any third-party user of a customer—uses PAMIRWEBHOST LLC’s services in a way that causes IP addresses to be blacklisted, PAMIRWEBHOST reserves the right to suspend or terminate the offending account.
This includes, but is not limited to, operating services on behalf of or in connection with individuals or entities listed in the Spamhaus Register of Known Spam Operations (ROKSO) at www.spamhaus.org.

16. Security

Users are prohibited from violating or attempting to violate the security of the PAMIRWEBHOST. Violations of system or network security may result in civil or criminal liability.
PAMIRWEBHOST will investigate occurrences, which may involve cooperation with law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:
1) Accessing data not intended for such user or logging into a server or account, which such user is not authorized to access,
2) Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization,
3) Attempting to interfere with service to any user, host or network, including, without limitation, via means of ‘overloading’, ‘flooding’, ‘mail bombing’ or ‘crashing’,
4) Forging any TCP/IP packet header or any part of the header information in any e-mail or forum posting,
5) Taking any action in order to obtain services to which such User is not entitled,
6) Attempting to couple many hosting packages together to take advantage of massive space or bandwidth allocations, Each hosting package purchased is unique to a do main name and use – you are not allowed to purchase multiple plans to obtain combined bandwidth & space.
PAMIRWEBHOST will stop such transactions and label them as deceptive. We have an upgrade path for all services and we can often times work out special deals for users if they ask us for the assistance. Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

17. Denial of Service Attacks

Any activity that disrupts or interferes with the ability of other users or systems to access services is strictly prohibited. This includes, but is not limited to, Denial of Service (DoS) attacks targeting other networks, hosts, or individual users.
Clients are responsible for ensuring their servers are securely configured. Allowing others to use your network for illegal or inappropriate actions—whether through action or inaction—may result in immediate account termination. Unauthorized access to another individual’s or organization’s systems is a serious violation and will be prosecuted accordingly.

18. Liabilities

PAMIRWEBHOST LLC makes no claims, endorsements, or guarantees regarding the services offered by its customers. We are not liable for any disputes, damages, or claims arising from customer activities.
Under no circumstances shall PAMIRWEBHOST LLC be held liable for direct, indirect, incidental, consequential, special, or exemplary damages resulting from the use or performance of our website or services. We are not responsible for content hosted on any server within our network unless a complaint is formally submitted to us via email.

19. Payment Verification

To protect both customers and PAMIRWEBHOST LLC from fraudulent transactions, we may require payment verification for certain payment methods. This may include: – A completed Credit Card Authorization Form – A screenshot of the front side of the credit card used – A valid photo ID (e.g., passport, driver’s license, student ID) Verification may be requested for payments made via Credit/Debit Cards, Payza, or unverified PayPal accounts. Failure to comply may result in service suspension or cancellation.

20. Service Renewal

PAMIRWEBHOST LLC will notify customers 45 days prior to service expiration. Renewal invoices are generated 15 days before expiry, with a 15-day due date.
If the renewal invoice is not paid by the due date:
– The service will be suspended.
– Data will be retained for 30 days after the due date.
– After 30 days, if payment is still not received, all data will be permanently deleted with no possibility of recovery.

21. VPS & Dedicated Servers

– VPS services include a 7-day money-back guarantee, provided the IPs have not been abused or blacklisted.
– Dedicated Servers have no money-back guarantee under any circumstances.
All VPS and Dedicated Servers are unmanaged unless the customer purchases Full Management along with cPanel/WHM/Plesk.
Customers are responsible for:
– Backing up their own data
– Monitoring hardware performance
– Ensuring compliance with all TOS/AUP policies
Resellers and VPS/Dedicated Server customers are fully liable for the actions of their subaccounts. Violations by subusers—whether intentional or accidental—are the responsibility of the account holder. Owners must actively monitor subaccounts to ensure compliance with PAMIRWEBHOST LLC’s policies.

22. Free Web Hosting

Hosting websites that offer free web hosting services is strictly prohibited on PAMIRWEBHOST LLC servers. If an account is found to be in violation of this policy, the account owner will be issued a warning and instructed to remove the offending content.
Repeat violations will result in permanent suspension of the account and all associated accounts. The term “free” is interpreted broadly and includes services offered at nominal prices (e.g., $0.01/month or $1/year). PAMIRWEBHOST LLC reserves the right to determine, at its sole discretion, whether a site qualifies as offering free hosting.

23. Free domain Offers

Free domain offers are governed by our Domain Names Policy. Customers are encouraged to review this policy for full details regarding eligibility, limitations, and terms.

24. Data Loss & Backups

The customer is responsible for keeping a copy of their most current web site files as backup on a remote system (not on same server where his account is hosted).
PAMIRWEBHOST is not responsible for any lost files, information, or data. Hardware is mechanical and by nature mechanical hardware is prone to failure. If so subscribed, Daily and Weekly Backups are performed on a best effort basis, should an event occur where our backup script was unable to complete the backup and the server’s hard drive fails, we hold no responsibility.
Please make sure you have off-site backups! We do our best, but sometimes things may go wrong! Renewal and Billing Schedule. Client has fifteen (15) days to remit payment to PAMIRWEBHOST after first email notification to the billing contact of an upcoming renewal.
Accounts receive notification of an upcoming renewal 15 days prior to the due date as well as the day prior to the due date. The 15 days advance notice serves as your grace period, if payment is not received by the due date, your account is considered to be in default and at risk of service interruption. Payment must be received or services are not rendered. Should you need an extension, please contact the billing department PRIOR to the due date. We are very understanding and lenient, but we must receive communication from the client. If you know you will be away on vacation, business or otherwise unable to communicate with us or remit payment, ensure that you notify us prior to being unreachable or make the payment(s) in advance. If payment is not received BY THE DUE DATE, expect service interruption. Any interrupted service will incur a $25 re-connection penalty. Returned or bounced checks will incur a $35 processing and handling penalty in addition to the bank assessed NSF fee’s. PAMIRWEBHOST reserves the right to change prices at any time on month to month services. Month to month means you are not locked into a contract and terms may change for the new upcoming month. You do have an option to enter into a term contract should you so wish.
All monetary transactions will occur in US dollars and AFN Afghani.

25. Disclaimer

PAMIRWEBHOST LLC’s Terms of Service are subject to change without prior written or digital notice. Customers are responsible for reviewing the TOS before placing orders and periodically thereafter to stay informed of updates.
